PANDYA MEMORIAL HOSPITAL ON SPOT, AS DOCTOR IN COURT OVER ALLEGED SEXUAL ASSULT OF DIALYSIS PATIENT

 A doctor from Pandya memorial hospital in Mombasa county appeared in court today over allegation of sexually harassing  a dialysis patient. The victim's statement to the police says that the harassment begun late December 2024, multiple reports to the hospital's management went unanswered. The case escalated to rape on January 31st 2025.


The 31 years old doctor Dias Juma Wabwire however denied the charges before Mombasa Law Court Chief Magistrate  Alex Ithuku, he was released on a bond of ksh.500, 000. The case will be mentioned on 17th of February 2025. 

In a statement from Pandya Memorial Hospital, said they first learned of the matter on Friday 31st, January 2025 at 9 a.m. denying claims that the case had been reported earlier. The hospital assured the public that it had taken necessary measures, including providing medical care to the victim and cooperating with authorities in the doctor’s arrest.

The Federation of Women Lawyers (FIDA) Kenya strongly condemned the alleged assault and vowed to ensure justice is served. Jane Anyango, FIDA Kenya Coast representative, called on the Office of the Director of Public Prosecutions (ODPP) and the Directorate of Criminal Investigations (DCI) to conduct a thorough investigation

“We are very glad that the court has granted us earlier date for mentioning, we are also calling for the immediate suspension of the nurse and the doctor's license by the Kenya Medical Practitioners and Dentists Union (KMPDU), the Nursing Council of Kenya (NCK), and any other relevant medical bodies, until the case is concluded and incase they're found guilty, we demand that they be deregistered from from any service that involve the patients” Anyango stated.

She also revealed that FIDA Kenya would be writing to the Mombasa County Ministry of Health within five days to demand stricter patient safety measures in hospitals. FIDA Kenya will also be failing civil lawsuit against against Pandya Memorial Hospital Mombasa and seek compensation for the survivor for the gross negligence and failure to protect her. 

Zedekiah Adika, chairperson of the Coast Civil Society, urged other potential victims to come forward to strengthen the case.

“If anyone else has ever been assaulted by the accused, they should step forward, report to any civil society organizations in the region and help build the case,” Adika said.

Meanwhile, Terry Mwongeli, an advocate for patient safety, emphasized the need for caregivers to closely supervise patients in medical facilities.

“Parents and caregivers should closely escort their patients because we cannot be certain of their safety in hospitals anymore,” Mwongeli stated.

The case continues to draw public attention, with Human rights groups demands for accountability as investigations proceed.
